Rhode Island's assisted living rules are unusually specific about what a residence is licensed to handle, which makes admission and retention cases provable.
Rhode Island assigns assisted living residences a level of licensure that defines which residents they may admit, including fire safety and medication classifications. Before admission or the signing of a residency agreement, the administrator must have a comprehensive assessment of the resident's health, physical, social, functional, activity and cognitive needs conducted and signed by a registered nurse, and that assessment is used to determine whether the residence can meet those needs at its licensure level.
For counsel that creates a documented decision point. If the assessment shows needs the residence was not licensed to meet, or if the resident declined past that level and the residence retained them anyway, the record of the decision exists and can be compared against the service plan and the charges.
Administrators of residential care and assisted living facilities must be certified under R.I. Gen. Laws ยง 23-17.4-15.2, and one qualifying route is a current Rhode Island nursing home administrator licence. That matters when the standard of care question is administrative rather than clinical.
