Nursing home expert witnesses in New Hampshire

New Hampshire licenses nursing homes and residential care facilities under one chapter, and it imposes a dementia training duty that most states do not.

RSA 151 is the starting point

Residential care and health facility licensing in New Hampshire sits in RSA chapter 151, administered by the Department of Health and Human Services. It covers licences and licensure requirements, investigations, patient rights, and remedies, and it applies to nursing homes, other residential care facilities and assisted living residences.

The dementia training duty is a live theory

Where a case involves wandering, exit-seeking, resident-on-resident aggression or behavioural management, the statutory training requirement gives counsel something concrete to test: whether the staff on duty had completed the required initial and continuing dementia training, and whether the facility can produce the records. That is an administrator and Director of Nursing question, and it is often unanswered in the first production.

Certified facilities carry both frameworks

A New Hampshire nursing home certified for Medicare or Medicaid is subject to the federal requirements at 42 CFR Part 483 and the F-tag framework as well as RSA 151 licensure. Expect to work both, and request the CMS Form 2567 results alongside the state licensing inspection record.
