Nursing home expert witnesses in Connecticut

Connecticut is an opinion-letter state, which makes expert selection a gating decision rather than a later one.

The opinion letter controls the schedule

Connecticut General Statutes § 52-190a requires a claimant in a negligence action against a health care provider to make reasonable inquiry and to file a certificate of good faith, accompanied by a written and signed opinion from a similar health care provider stating that there appears to be evidence of medical negligence and giving a detailed basis for that opinion. Failure to attach a compliant opinion letter can support dismissal, and the statute also provides a ninety-day extension of the limitation period to allow the inquiry.

Two features matter for expert selection. First, similar health care provider is a defined term under § 52-184c, and the qualification of the author has to be apparent from the letter itself. Second, in Dias v. Grady, 292 Conn. 350 (2009), the Supreme Court held that medical negligence in § 52-190a means a breach of the standard of care, so the opinion letter is not required to address causation.

What that means when you call ECS

  • Tell us at the outset that the venue is Connecticut and whether you are proceeding as malpractice or ordinary negligence
  • Tell us the defendant's discipline, because the similar health care provider analysis flows from it
  • Send the records that show the deviation, since the letter must give a detailed basis
  • Give us the limitation date and whether the ninety-day extension has been invoked

Oversight and records

Connecticut nursing homes are licensed and surveyed by the Department of Public Health, which also conducts federal certification surveys, so CMS Form 2567 results and the federal requirements at 42 CFR Part 483 apply to certified facilities alongside state licensure standards. Assisted living in Connecticut is regulated separately and is not governed by the federal nursing home requirements.
