Nursing home abuse and neglect expert witness
Abuse cases are usually not about whether an event occurred. They are about what the facility did before and after it: who it hired, how it supervised, whether it recognized the warning signs, whether it reported on time, and whether its investigation was designed to find the truth or to close the file.
The regulatory structure is unusually explicit. F600 establishes the resident's right to be free from abuse, neglect, misappropriation, and exploitation. F607 requires written policies prohibiting abuse and covering screening, training, prevention, identification, investigation, protection, and reporting. F609 sets reporting timelines to the administrator and the state agency, including the two-hour standard where serious bodily injury is alleged. F610 requires that allegations be investigated, that the resident be protected during the investigation, and that corrective action follow.
Resident-on-resident aggression is the subset most often mishandled. The aggressor usually has a documented behavioral history, and the question becomes whether the facility care planned it, monitored it, and separated residents when it should have.
Records to request
- Incident reports and all statements taken during the investigation
- The facility's report to the state agency and any ombudsman correspondence
- Complete investigation file, including timelines and conclusions
- Personnel file for the accused staff member: application, references, background check, discipline
- Abuse prohibition policy and annual abuse training records
- Behavior care plans for both residents where aggression is alleged
- Nurse notes, ADL flow sheets, and body audit or skin check records
- Photographs of injuries and any medical evaluation of them
- Grievance logs and resident council minutes
- Survey history, particularly citations at F600, F607, F609, or F610

- Was the accused employee screened before hire, and does the file show prior complaints?
- Was the allegation reported within the required timeframe, and to whom?
- Was the resident protected during the investigation, or did the same staff continue to provide care?
- Does the investigation file reflect an actual inquiry, or a conclusion with no supporting steps?
- For resident-on-resident aggression, was the aggressor's behavior care planned and monitored?
